NEW LONDON TOWNSHIP BOARD OF SUPERVISORS

WORK MEETING MINUTES

July 16, 2008

The New London Township Board of Supervisors Work Meeting convened at 7:30 PM at the New London Township Building, New London, PA.  The following Supervisors were present:   Chairman, Dale Lauver; Vice Chairman, Robert Barto; Member, Gerard Porter.

No public comment.

SCHEDULED ACTION/PRESENTATION TOPICS

A public hearing was held prior to the July 16, 2008 Work Meeting to discuss the following Ordinances: 2008-2 – An Ordinance of New London Township, Chester County, Pennsylvania, amending the compilation of Land Use Ordinances of New London Township, Chapter 1, Zoning, regarding Accessory Structures in front yards, Zoning Officer duties, Accessory Dwellings, and removal of Residential Cluster Design Option; 2008-3 – An Ordinance of New London Township, Chester County, Pennsylvania, amending the compilation of Land Use Ordinances of New London Township, Chapter 1, Zoning, regarding New London Village [NLV] District and Traditional Neighborhood Development [TND] Overlay District; 2008-4 – An Ordinance of New London Township, Chester County, Pennsylvania, amending the compilation of Land Use Ordinances of New London Township, Chapter 2, Subdivision and Land Development, regarding procedure to request waiver from land development plan requirements and stormwater management regulations; 2008-5 –  An Ordinance of New London Township, Chester County, Pennsylvania, amending the compilation of land use ordinances of New London Township, Chapter 4, Definitions, regarding Accessory Dwelling Unit, Traditional Neighborhood Development (TND) Overlay District, and Stormwater Management Ordinance; and 2008-6 – An Ordinance of New London Township, Chester County, Pennsylvania, amending the compilation of Land Use Ordinances of New London Township, by adding new Chapter 5, Water, Part 1, Stormwater Management Ordinance. On a motion made by Dale Lauver, seconded by Gerry Porter, the Ordinances were adopted.  The vote was unanimous.

London Bridge II Homeowners Association

On a motion made by Bob Barto, seconded by Gerry Porter the request of the Homeowners Association  to delete a portion of their Homeowners Association Agreement was denied.    The vote was unanimous. 

Thunder Hill Road Speed Hump

Dale stated that he believes that the speed hump’s construction needs to be reviewed and he feels it should be removed.  Gerry Porter stated that he spoke with Roadmaster Jack Arrell and they agreed that it needs to be milled and signage improved.  Bob Barto asked Jack Weber, Chairman of the Road Enhancement Committee for his opinion.  Jack Weber agrees that it should be milled, painted and signage improved.  On a motion made by Bob Barto, seconded by Gerry Porter, the speed hump will be lowered and to also look at a more global answer to traffic calming  The vote was unanimous. 

Tree Removal on Route 896, Bordering the Alpine Estates Subdivision

A resident that will be affected by tree removal has asked for partial tree replacement by the Township.  Bob Barto explained that other residents will be affected by tree removal and if tree replacement were to take place, the cost for the project would greatly escalate.  On a motion made by Bob Barto, seconded by Gerry Porter, tree replacement was denied and tree removal conditioned upon the road work beginning in 30 days was approved.  The vote was unanimous.

Resolution No. 2008-7-1 – Revision to Acceptance of Right of Way for Final Subdivision Plan of “Alpine Estates

On a motion made by Dale Lauver, seconded by Bob Barto, Resolution No. 2008-7-1 , acceptance of Right of Way is adopted.  The vote was unanimous.

Meadowcroft Knoll Retention Pond

Bob King stated that he was informed by Township Engineer, Ron Ragan that the Board of Supervisors have agreed not to pursue working with the Developer to rework the retention pond.  Mr. King gave an overview of actions regarding this pond.  Dale Lauver stated that the Chester County Conservation District signed off on the design of the stormwater basin.  Bob Barto stated that the Board of Supervisors agreed that they would not pursue the Developer to make it a wet pond.  The Board has not as yet discussed how it will proceed to look at making it a dry pond.  The Board is in agreement that the Chester County Conservation District will be contacted to address this issue.

Logue Subdivision

On a motion made by Dale Lauver, seconded by Gerry Porter, waivers and conditional Board of Supervisor approval upon DEP approval was granted.  The vote was unanimous.  The Sewage Maintenance Agreement was signed by the Board.

Secretary’s Report

On a motion made by Bob Barto, seconded by Gerry Porter, the June 18, 2008 Board of Supervisors Meeting Minutes were approved.  The vote was unanimous.

OLD BUSINESS/NEW BUSINESS

Lynn Shirey stated that she believes that there are no provisions for noise in the new Village District Ordinance.

Bob Barto referred to a letter from Signal Service, Inc. regarding missing signage where the traffic light is located.

The meeting adjourned at 9:05 PM.
