Right To Know Request Process

REQUESTS
Public records shall be accessible for inspection and duplication during regular business hours. Requests for Public Records will be fulfilled in accordance with the requirements of the Sunshine Act; the Right to Know Law; and Act 100 of 2002.

Verbal requests will be fulfilled; however, if the requester wishes to pursue the relief and remedies provided in the Sunshine Law, Right to Know Law or Act 100 of 2002, the requester must initiate such relief with a written request.

Written request shall be on a form provided by the Township and shall identify or describe the records sought with sufficient specificity to enable the Township Right To Know Officer to ascertain which records are being requested.

Written requests must include the name and address to which the agency may respond.

Written requests may be submitted in person, by mail, by email, or by facsimile and shall be directed to the Township Right To Know Officer at the New London Township Building, P.O. Box 1002, 902 State Road, New London PA 19360 or mzdun@newlondontwp.net.

RESPONSE
Upon receipt of written request for access to a record, the Township Right To Know Officer shall make a good faith effort to determine if the record requested is a public record and to respond as promptly as possible under the circumstances existing at the time of the request. The Township Right To Know Officer shall respond in writing within five business days from the date the written request is received.

The Township Right To Know Officer shall not be required to create a public record which does not currently exist or to compile, maintain, format or organize the public record.

A public record shall be provided to a requester in the medium requested if the public record exists in that medium; otherwise, it shall be provided in the medium in which it exists.

FEES
Paper copies will be $0.25 per page per side. If mailing is requested, the costs of postage will be charged. If a disk is requested, it will be provided by the Township at the cost of $1.00 per disk. A new disk will be necessary each time records are provided. Fax copies will be available at the cost of $0.50 per page. If “True and Correct Certification” is requested, an additional charge of $2.00 will be added per certification.

APPEALS PROCESS
If a written request is denied or deemed denied, the requester may file an appeal with the Office of Open Records. There is no fee, and you do not need an attorney.

All appeals must be made in writing and must be submitted to the Office of Open Records within 15 business days from the mailing date of the Agency’s response or the date that the request was deemed denied. If that timeframe expires before you provide the required information to the OOR, you lose your right to appeal and may need to file a new RTK request with the Agency.
