NEW LONDON TOWNSHIP BOARD OF SUPERVISORS
REGULAR MEETING MINUTES
AUGUST 2, 2012

The New London Township Board of Supervisors Regular Meeting convened at 7:30 PM.The following Supervisors were present:Chairman, Dale Lauver; Vice-Chairman, Robert Barto; Member, Gerard Porter.

PUBLIC COMMENT

No public comment on agenda items.

SCHEDULED ACTIONS/PRESENTATIONS

Thunder Hill Road

Township Engineer, Ron Ragan presented the Board with a drawing from the Elk Ridge Farms Subdivision showing the trees that existed at 869 Thunder Hill Rd. when the subdivision was built.  Ron stated that in order to ditch along the road, the right-of-way would need to be partially cleared and tapered back.  Ron will talk to Roadmaster, Jack Arrell about what needs to take place to permit water to drain properly.

Tax Collector

On a Motion made by Gerry Porter and seconded by Bob Barto, the Board of Supervisors decided to proceed with contracting with Berkheimer to collect real estate taxes for the Township.  The vote was unanimous.

Sunoco/A-Plus

Tom Davis of Bergmann Associates showed the Board of Supervisors the Land Development Plan submitted by Sunoco.  He explained that the Planning Commission recommended approval and the Conditional Use and Zoning Hearing Board hearings have concluded with conditioned approvals.  The waiver requested by Sunoco to the Zoning Hearing Board to receive deliveries from 5:00 am until 11:00 pm was not fully approved.  The Zoning Hearing Board approved 5:00 am until 10:00 pm for deliveries.  Construction is planned for the end of February or beginning of March 2013.

Resolution 2012-8-1 – Emergency Operating Plan

On a Motion made by Gerry Porter, seconded by Bob Barto, the Emergency Operations Plan was approved.  The vote was unanimous.

Resolution 2012-8-2 – Bylaws and Operating Plan of Avon Grove Regional Emergency Management (“AGREM”)

On a Motion made by Gerry Porter, seconded by Bob Barto, the Bylaws and Emergency Operating Plan for AGREM was approved.  The vote was unanimous.

Ordinances to CCPC

On a Motion made by Bob Barto, seconded by Gerry Porter, approval was given to send solar, wind, energy systems, walls and fences to Chester County Planning Commission and Township Solicitor for review.  The vote was unanimous.

Individual Operations & Maintenance Agreements for Alternate Septic Systems

Township Engineer Ron Ragan recommended that the Township receive notification from the property owners that inspections required by DEP and/or the manufacturer have taken place in the time specified.  The Board agreed to continue as required by Chester County Health Department to have an Operations & Maintenance Agreement in place and a $500.00 escrow in place.

STATE POLICE REPORT

Corporal Dwayne Winchester gave a report on incidents in the Township.

ADMINISTRATIVE ACTIONS

SECRETARY’S REPORT

On a Motion made by Gerry Porter, seconded by Bob Barto, the July 18, 2012 Board of Supervisors Regular Meeting Minutes were approved as written.  The vote was unanimous.

TREASURER’S REPORT

On a Motion made by Gerry Porter, seconded by Bob Barto, the Bills to Be Paid for July were approved and the financial reports were accepted as presented.  The vote was unanimous.

STAFF REPORTS

Planning Commission

Ron Ragan reported that there are no new Subdivision plans.  He reported that the Refuse & Recycling Ordinance is in process.

Engineer

Ron Ragan reported approximately 75’ of upright curb would help with the erosion problems at the northern portion of the intersection at State & Lewisville Roads.  A curb cut will be needed on the western side to allow water to run off.  The Board approved the plan.

Walnut Glen Road – Ron reported that he is waiting for utility poles to be moved back.

NPDES Permit.Ron advised the he refined outfall locations.The Application is due to be submitted mid-September.

Act 167 Stormwater Management Plan – Ron is attending meetings at the County.The County is planning to adopt by the end of the year and DEP is asking the townships to have their ordinances adopted in March.

Zoning Officer

Trish Fagan reported that eight (8) permits were issued in July.  One was for a single-family dwelling.

Emergency Management

There will be no meetings until September.

Property and Building Use

Outside painting has been completed.  Having public water in the building will be budgeted for 2013.  A fire suppression system will be explored.  On a Motion made by Dale Lauver, seconded by Bob Barto, the Elk Creek Enterprises invoice for work on the Township Building was approved.  The vote was unanimous.

Roadmaster Report

Jack Arrell spoke about receiving calls about a tree falling across a road.  The tree was not in the right-of-way, but when it fell, it blocked the road and therefore was removed.

The meeting adjourned at 10:25 PM.
