NLT PLANNING COMMISSION MINUTES FOR
8/10/11
The New London Township Planning Commission Meeting opened at 7:00 PM. Present were: Ronald Ragan, Chair; Vice Chairman, Mary Anne Steel; Members, Bob Barto, Charlie Humkey and Martha Straus. The minutes were recorded by Kim Malone.

Ms. Steel made a motion to approve the 7/13/11 Minutes and Mr. Humkey seconded the motion.

Yates Subdivision
Mr. Ragan reviewed his comments and open items from his August 9, 2011 Review letter. Most open items are waivers. Item #7 is resolved—Mr. Yates signed the plan and had it notarized. With respect to Item #13 (driveway easement for shared driveway), Mr. Ragan is waiting to hear from Sam McMichael, Township Solicitor. Under the Driveway Ordinance Section, item #3, Mr. Ragan doesn’t oppose the waiver to permit a 13.4% slope for a short portion of the shared driveway, since there’s a pull-off and parking spot ant the end and they do have sight distance. Concerns were raised regarding run-off onto Kirks Mill Rd. Mr. Ragan advised that because it’s a super elevated driveway, that shouldn’t be an issue. A concern was also raised regarding room for only one car to pull off at the end of the driveway. It was discussed and decided that that would be more of a homeowner’s liability issue rather than the Township’s. Under the Stormwater Management Section, there was discussion that as part of the MS4 requirements, the Township needs to ensure that the homeowner is checking that the drywell is holding water. Sam McMichael needs to review the Stormwater Best Management Practices Operations and Maintenance Agreement. Mr. Ragan feels that due to the difficult nature of the driveway slope issue, the waiver should be granted to allow the driveway slope to be exceeded up to 13.4%. Ms. Steel, Mr. Humkey and Mr. Barto were in agreement; Ms. Straus was not in agreement due to the lack of pull off at the end of the driveway. On a Motion by Bob Barto and seconded by Mary Anne Steel, the Yates Minor Subdivision Plan will be recommended to the Board of Supervisors for approval, with waivers.
Nichol Subdivision
Mr. Ragan advised that we are still awaiting the letter from the Chester County Planning Commission. The property is landlocked and parcel no. 71-1-47.2 needs frontage. The deed reflects the property as having 3 parcels described separately. Mr. Ragan advised he will get the deed from Ken Crossan, since he prepared the original deed. Mr. Ragan said that the PC’s concerns are: 1) the parcel situation needs to be squared away; and 2) we need to know whether there are plans to subdivide. The New London Presbyterian Church also owns part of the subject property, so we need to find out from the Church whether or not they are a party to this proposed subdivision. Barry Stingel from Hillcrest advised that he will list all waivers on the plan and will have letters from Chester County Health Department, County Planning Commission and the Church for next month’s meeting.
