NLT PLANNING COMMISSION MINUTES FOR

6/13/12

 

The New London Township Planning Commission Meeting opened at 7:00 PM.  Present were:  Ronald Ragan, Chair; Mary Anne Steel, Vice-Chair; Members, Bob Barto, Martha Straus and Charlie Humkey.  The minutes were recorded by Kim Malone.

Walnut Glen Road – Bank Cutting

There was discussion between the residents and the Planning Commission regarding bank cutting.  Ron Ragan advised everyone that the project needs to be completed to address safety issues.  Topics discussed ranged from curbing, drainage and right-of-way.  Mr. Ragan advised that the project will commence sometime mid-summer and will hopefully be completed before school starts.  A resident expressed his dissatisfaction over what was done a few years ago (he says) without notice.  Another resident spoke regarding curbing and wants to know exactly what will be moved (he asked that the Township mark the plantings to be moved).  Another resident spoke about drainage onto his driveway, and Mr. Ragan advised that he will think about how to address this issue.  4-way stop signs were discussed for traffic calming purposes and the resident was advised that 4-way stop signs are not meant to slow traffic down.   Speed humps were discussed to slow traffic down.  Mr. Ragan advised another resident that he would walk his property to discuss the course of action one night next week.  Mr. Ragan also reported that he would look into weight limit of the bridge.  A resident raised questions about putting boulders or rebar on his property to stop people from driving onto it.  Mr. Ragan suggested plastic reflective markers would be safer and there was brief discussion regarding potential liability issues related to boulders or rebar causing damage to vehicles.

Minutes

Mr. Ragan asked if there were any corrections or additions to the Minutes for 1/11/12. Mr. Humkey made a motion to approve the Minutes and Ms. Steel seconded the motion.  The vote was unanimous.

Sunoco-A-Plus

Mr. Ragan distributed his findings letter dated 6/13/12 as well as a letter from the Chester County Planning Commission. Tom Davis introduced himself, Lori Petingill and Clayton McCain, representing Sunoco. Mr. Davis advised that the project will be started at the end of this year or early next year.  PennDOT is doing a review for sight distance.   Mr. Davis advised that Sunoco is in compliance with signage and a zoning variance request is in for LED lights.  Another variance item is hours of delivery; since there are no deliveries allowed on Sundays or holidays, 3-day holiday weekends can create a hardship for Sunoco.  Mr. Ragan advised that the Chester County Planning Commission letter comments on the number of waivers and variances requested, but he feels since it is an existing site, it warrants approving the waiver and variances, and most items have been resolved.  Mr. Ragan advised that the plan will be looked at again at the July 11th Regular Meeting and advised that the earliest action can be taken will be at the July 26th Work Meeting as long as Sunoco is granted relief at the July 25th Hearing.

Possible Dog Neglect

Nicole Coggins, a resident of New London Township came in to express her concerns about a neighbor’s dog who she feels is being neglected.  Mrs. Coggins reported that the dog in questions has no shelter or water and is kept outside in all kinds of conditions, 24 hours a day.  She questioned the possibility of an anti-chaining ordinance or at least a time-limiting ordinance.  Mr. Ragan explained that New London Township is a 2nd class Township and there are certain things the Township is delegated to do.  The SPCA agent investigating this matter is Officer Shaw.  Mr. Ragan advised that the Planning Commission will look into possible Ordinances.
